Terms of Use

1. Who you are dealing with

Climate Scout Pro ("the app") is published by Gani Tunc, a sole trader established in Germany. Full contact details are in the Legal Notice. These terms govern your use of the app. By installing or using it, you accept them.

2. What the app does

The app analyses historical weather records for a destination and a date range and presents averages, probabilities, activity suitability scores, packing suggestions and destination comparisons.

3. This is not a forecast

Do not rely on the app for decisions where weather affects safety — mountaineering, sailing, aviation, diving, severe-weather planning or similar. Use official meteorological services and current forecasts for those. The packing lists and activity scores are convenience suggestions, not professional advice.

4. Data accuracy

Weather and climate data comes from Open-Meteo.com under the CC BY 4.0 licence. We do not produce this data and cannot guarantee its accuracy, completeness or continued availability. Some data types are not available for all periods; the UV index, for example, only exists from 2021 onwards, and is hidden when it is unavailable rather than shown as a wrong value.

If some historical years cannot be retrieved, the app tells you how many were actually used.

5. Free use and Pro subscription

The app can be used free of charge with a daily limit on analyses and comparisons, and a shortened day-by-day breakdown. A Pro subscription removes those limits and unlocks the full breakdown and the shareable report card.

• Subscriptions are sold and billed by Apple through In-App Purchase. Apple is the merchant of record for the transaction.
• Prices, the subscription period and any free trial are shown in the app before you confirm, in your local currency.
• Payment is charged to your Apple Account at confirmation of purchase.
• A subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• Where a free trial is offered, it converts into a paid subscription unless cancelled at least 24 hours before it ends. Any unused part of a free trial is forfeited if you buy a subscription during the trial.
• You can manage or cancel a subscription at any time in the iOS Settings app under your name → Subscriptions, or via Settings → Manage Subscription in the app.

6. Right of withdrawal for consumers in the EU

Purchases are made from Apple, so Apple's own terms and refund process apply, and refund requests go to Apple rather than to us (reportaproblem.apple.com). Statutory consumer rights under EU and German law remain unaffected by these terms.

7. Acceptable use

You agree not to:

• attempt to bypass the free-tier limits or the purchase verification;
• decompile, reverse-engineer or redistribute the app, except where applicable law expressly permits it;
• use the app in a way that places an unreasonable load on the underlying weather services;
• republish bulk data obtained through the app as a competing dataset or service.

8. Intellectual property

The app, its name, its design and its original content are protected by copyright and remain the property of Gani Tunc. Weather data remains subject to the CC BY 4.0 licence of its provider. Reports you generate are yours to share.

9. Liability

We are liable without limitation for damage arising from injury to life, body or health, for damage caused intentionally or by gross negligence, and under the German Product Liability Act (Produkthaftungsgesetz).

For slight negligence we are liable only where a material contractual obligation has been breached — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — and in that case liability is limited to foreseeable damage typical of this kind of contract.

Beyond that, liability is excluded. In particular, we accept no liability for travel decisions taken on the basis of historical weather statistics, or for the accuracy or availability of third-party data.

10. Availability and changes

The app depends on third-party services and may be temporarily or permanently unavailable. We may add, change or remove features, in particular where a data provider changes its service or licensing terms. Changes that materially reduce the value of an active subscription will be announced in the App Store release notes.

11. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you are habitually resident.
